My partner has made a claim under s75 against her bank for a product which is not of a satisfactory quality. Various latent defects materialised over a 20 month period with the longest period between defects being about 7 months. The product is a motorcycle safety helmet and the buyer has lost confidence in the product. The supplier claimed acceptance and offered a partial refund. The creditor requested an independent report on the product.
A case has been brought against the creditor under s75 CCA and I would like advice as to whether there is a case to argue in court. All documentation is available, receipts, warranty repair receipts and correspondence.
