He was found guilty of the manslaughter of his 55-year-old victim in Croydon, South London, on 14 April 2012. He was found not guilty of murder. The court heard that he used excessive force repeatedly stamping on his victim's head after going to his home with his co-defendant. His co-defendant was in drink and accused the victim of supplying her sister with cocaine when a fight broke out. His victim died from his injuries on 18 April 2012. His co-defendant was found not guilty of murder and manslaughter.

The judge said: "He was no physical match for you - you were younger, bigger and stronger then him... I am satisfied he only used force against you to get you out of the flat when you refused to leave... he had been disarmed of the bat and no longer represented a threat... I accept that Cherri Gilmartin bears a large moral responsibility for what took place that night. If it had not been for her I am satisfied you would not have got involved in the violence that took place. Ironically, she was acquitted. She will have to live with the consequences because of this conviction and sentence which arises out of her drunk, aggressive and abusive conduct."
