How can we legislate against a basic right that all defendants should have? How can you possibly have a fair trial without knowing who is giving evidence against you? I think this will come up against problems if anyone tries to challenge it with the Human Rights Act in mind.

The draft legislation allowing witness anonymity will not go far enough!     (Posted on: 2008-07-04 00:12:26)

Common law and European human rights law require that a defendant be able to confront his accusers and cross examine them properly and not \'take blind shots at a hidden target\' and any legislation will be interpreted in light of this ruling which will allow ANONYMITY only in exceptional cases. This has probably already deterred potential witnesses. I saw nothing - but maybe the flood- or prison -gates open!
